What Changed

A senior European Commission adviser signaled in April 2026 that a sequel to the Markets in Crypto-Assets Regulation — informally referred to as "MiCA 2" — is forthcoming, with a public consultation expected to launch soon. MiCA 2 is expected to address DeFi regulation (which MiCA 1 largely exempted), NFT-specific provisions, crypto lending frameworks, and expanded stablecoin oversight incorporating lessons from the GENIUS Act's approach.

Who It Affects

Every CASP operating in the EU, DeFi protocols serving EU users, NFT platforms, and crypto lending services that currently operate outside MiCA's scope. Firms that invested heavily in MiCA 1 compliance should prepare for an expanded regulatory perimeter.

What to Do

Track the MiCA 2 consultation timeline. If you operate a DeFi protocol, NFT marketplace, or crypto lending platform serving EU users, begin assessing which aspects of your operations may be brought within the regulatory perimeter. Submit comments during the consultation period to shape the framework.
